WAIVER AND RELEASE OF LIABILITY FORM FOR PARTICIPATION IN EVENTS AND ACTIVITIES HOSTED BY 6OVER9 PRODUCTIONS, LLC AND MEMBERSHIP IN 6OVER9 PRODUCTIONS I, [MEMBER NAME] , of [MEMBER ADDRESS] in exchange for participation in the events and activities (“6over9 Events”) organized and hosted by 6over9 Productions, LLC at 7550 W. 62nd Ave, Arvada Co. 80003-4836 1. I understand that the events hosted by 6over9 Productions, LLC are adult oriented activities. Some of the events are clothing-optional. At the events there may be alcohol served and cannabis being smoked or used. There may be physical activities such as dancing or swimming and there may be consensual sexual activity. If these activities are not acceptable to me, I shall not participate. 2. I understand that participating in these events and activities may involve inherent risks of physical or psychological injury or illness, and I assume all related risks, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault. 3. I certify that I am physically and mentally fit to participate in these activities, and that I voluntarily participate. I further state that I am over the age of ____, and there is no legal reason which would prohibit my participation. 4. I acknowledge that this Waiver and Release of Liability will be used by the event sponsors and organizers of the activities in which I may participate, and that it govern my actions and responsibilities at said activities. In consideration of permitting me to participate in these activities, I hereby agree for myself, my executors, heirs and next of kin as follows: A. I WAIVE, RELEASE AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence of fault of the entities or persons released, for my death, physical or mental personal injury, disability, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to or from this activity, THE FOLLOWING ENTITIES OR PERSONS: 6over9 Productions, LLC, Gregory S. , and/or -1- their directors, officers, managers, employees, representatives, and agents, and the activity holders, sponsors, and their employees and volunteers. B. I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE 6over9 Productions, LLC, and/or their directors, officers, managers, employees, representatives, and agents, and the activity holders, sponsors, and their employees and volunteers from any and all liabilities or claims made as a result of participation in these activities and events, whether caused by negligence or otherwise. C. This Release for participation in event or activity (“Release”) shall not be in any way construed as an admission by the Releasee that it acted wrongfully with respect to me or any other person, that it admits liability or responsibility at any time for any purpose, or that I have any rights whatsoever against the Release. D. I certify that I have carefully read and fully understand all of the provisions of this Release and I am freely, knowingly and voluntarily entering into this Release. THIS AGREEMENT COMMENCES FROM THE DATE OF PURCHASE OF CLUB MEMEBRSHIP.
